Welcome to MySkin Medical Spa (“Company,” “Practice,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website located at https://www.myskinmedicalspa.com (the “Site”), as well as your scheduling, booking, purchasing, and receipt of any aesthetic medical services, clinical consultations, or retail skin care products provided by MySkin Medical Spa in Orange County, California.

By accessing our Site, booking an appointment, or receiving treatment at our facility, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Site or services.

1. California Medical Practice Disclaimer & Good Faith Examination

  • Corporate Practice of Medicine Notice: In accordance with California law (Cal. Corp. Code § 13400 et seq.), all medical aesthetic services—including, but not limited to, neurotoxin injections, dermal fillers, medical-grade laser therapies, microneedling, and chemical peels—are rendered by or under the medical direction of a California-licensed physician or a professional medical corporation. Non-medical administrative operations are managed separately.

  • Mandatory Good Faith Examination (GFE): Pursuant to California Business & Professions Code § 2242, prior to receiving any medical aesthetic procedure for the first time (or when initiating a new treatment plan), every client must undergo a Good Faith Examination (GFE) conducted by a California-licensed Physician (MD/DO), Nurse Practitioner (NP), or Physician Assistant (PA).Registered Nurses (RNs) and licensed estheticians cannot perform GFEs.

  • Educational Content Only: Information provided on this Site is for general informational and educational purposes only and does not constitute medical advice, diagnosis, or treatment.

  • Emergency Care: If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Do not rely on electronic messages, website contact forms, or SMS for urgent medical concerns.

2. Client Eligibility & Medical Disclosures

  • You must be at least 18 years of age to independently book or receive medical aesthetic services at MySkin Medical Spa.

  • You agree to provide full, truthful, and accurate information regarding your health history, medical conditions, prescription medications, allergies, pregnancy/lactation status, and prior cosmetic procedures during your GFE and intake process. Withholding clinical information increases treatment risks and releases MySkin Medical Spa and its treating clinicians from liability resulting from undisclosed conditions.

3. Booking, Deposit & Cancellation Policy (Orange County Location)

  • Booking Deposit: A non-refundable deposit of $[Insert Amount] is required to secure all medical aesthetic appointments. This deposit will be applied directly toward your total service balance on the date of treatment.

  • Cancellation Window: We require at least 48 hours advance notice to reschedule or cancel an appointment without penalty.

  • Late Cancellations & No-Shows: If you cancel or reschedule within less than 48 hours of your scheduled time, or fail to appear for your appointment ("no-show"), your booking deposit will be strictly forfeited. Clients enrolled in prepaid series, packages, or monthly memberships will be assessed a $[Insert Amount] fee or forfeit that individual treatment session.

  • Late Arrivals: Arriving more than 15 minutes late may require us to shorten your procedure time or reschedule your appointment to maintain our clinical schedule. Rescheduled appointments due to late arrival will be treated as late cancellations.

4. Refund Policy, Packages & Expirations

  • No Refunds on Completed Medical Services: Medical aesthetic treatments produce individual, non-standardized biological responses. Because fees cover specialized medical products, clinical expertise, and professional time, all completed procedures and opened retail products are strictly non-refundable.

  • Prepaid Treatment Packages: Prepaid treatment bundles or series are non-refundable and non-transferable. All sessions within a package must be redeemed within 12 months from the date of purchase, after which any remaining unused sessions expire and become void.

  • Gift Cards: Gift certificates and digital gift cards issued by MySkin Medical Spa are non-refundable and cannot be redeemed for cash, except as required under California law (e.g., cash redemption for balances under $10 upon request per Cal. Civ. Code § 1749.5).

5. Mobile SMS/MMS Communications (A2P 10DLC Terms)

By providing your mobile telephone number to MySkin Medical Spa on our website, scheduling platform, or intake forms, you explicitly consent to receive transactional, operational, and promotional text messages from us.

  • Message Types: Messages include appointment confirmations, GFE links, post-treatment care instructions, bill notifications, and promotional updates.

  • Opt-Out Instructions: You may unsubscribe from SMS communications at any time by replying STOP, END, or CANCEL to any text message received from us. You will receive one final confirmation text.

  • Customer Support: For SMS support, reply HELP to any text message, or call us at [Insert Phone Number] / email [Insert Support Email].

  • Rates & Frequency: Message frequency varies based on your appointment activity. Standard message and data rates may apply based on your cellular plan.

  • Carrier Privacy Safeguard: Mobile numbers and SMS consent data collected for text messaging will never be sold, rented, or shared with third-party marketers or external affiliates for independent marketing purposes.

6. Intellectual Property & Website Use

All original text, custom graphics, photographs, branding marks, and layout design contained on myskinmedicalspa.com are the exclusive intellectual property of MySkin Medical Spa and protected under U.S. copyright and trademark laws. Unauthorized copying, downloading, or redistribution of site content without prior written permission is prohibited.

7. Limitation of Liability

To the maximum extent permitted under California law, MySkin Medical Spa, its affiliated medical corporations, supervising physicians, licensed clinicians, officers, and employees shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of this Site or receipt of non-negligent cosmetic services.

8. Governing Law & Orange County Venue

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles. Any legal action, proceeding, or dispute arising out of or relating to these Terms, our website, or services rendered shall be brought exclusively in the state courts located in Orange County, California (e.g., the Superior Court of California, County of Orange - Central Justice Center in Santa Ana, CA).

9. Modifications to Terms

We reserve the right to amend or update these Terms at any time to reflect changes in California medical board guidelines, state statutes, or practice policies. The revised Terms will take effect immediately upon being posted to the Site with an updated "Last Updated" date.
